If you are a victim of domestic violence, a court order called an Order of Protection or a restraining order may be obtained in order to offer you, your family and your children legal protection from further acts of violence or abuse. An Order of Protection will set specific limits that must be followed and obeyed by the abuser, including the following:
- No further emotional, physical or sexual abuse of any kind
- Removal of the abuser from your home (even if the abuser’s name is on the lease/deed)
- Stay away from you, your home, workplace and place of education
- Do not contact you in anyway including by phone, letter, email or through a third party
- Stay away from your children, day care, or school
- Turn in all weapons
- Pay for medical or property damage expenses related to the abuse
- Attend domestic violence counseling services

A judge may issue an emergency temporary Order of Protection following domestic violence or acts of abuse the same day the violence and/or abuse takes place, if he or she feels that the victim is still in danger of further abuse. The temporary Order of Protection will remain in effect until a hearing takes place. When the hearing takes place, an Order of Protection may then be granted by the judge for up to 2 to 5 years.
